Terms of Service

1. Agreement to Terms

By accessing or using UnsubNinja ("the Service"), operated by DATECH CONSULTING, LLC ("we," "us," "our"), you agree to be bound by these Terms of Service ("Terms"). If you don't agree, please don't use the Service.

These Terms apply to all visitors, users, and others who access the Service, including our website at unsubninja.com, mobile apps, and browser extensions.

2. What UnsubNinja Does

UnsubNinja is an inbox management tool that helps you unsubscribe from unwanted emails and clean up your inbox. To do this, you grant us access to your email account through your email provider's authentication system (like Google OAuth).

By connecting your email, you also acknowledge that we collect anonymized email metadata to create market research products, as described in our Privacy Policy. You can opt out of data monetization at any time through your account settings.

3. Your Account

• You must be at least 16 years old to use UnsubNinja.
• You're responsible for maintaining the security of your account.
• You're responsible for all activity that occurs under your account.
• You must provide accurate information when creating your account.
• One account per person. Don't create accounts for bots or automated systems.

4. What You Grant Us

When you connect your email account, you grant us a revocable, non-exclusive license to:

• Access and process your email data to provide inbox management features
• Collect email metadata as described in our Privacy Policy
• Create anonymized, aggregated derivative data products for commercial purposes

You can revoke this license at any time by disconnecting your email account or deleting your account. Once revoked, we stop collecting new data immediately. Previously anonymized and aggregated data that can no longer be linked to you may be retained.

5. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or to violate any laws
• Attempt to reverse-engineer, decompile, or disassemble the Service
• Interfere with or disrupt the Service's infrastructure
• Scrape, crawl, or use automated means to access the Service (beyond normal app usage)
• Impersonate another person or misrepresent your identity
• Use the Service to send spam or unsolicited emails
• Attempt to access other users' data or accounts
• Resell or redistribute the Service without our written permission

6. Intellectual Property

The UnsubNinja name, logo, website, app, and all related content, features, and functionality are owned by DATECH CONSULTING, LLC and are protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

Your emails remain yours. We claim no ownership over your email content. The anonymized, aggregated data products we create from metadata are our intellectual property.

7. Third-Party Services

UnsubNinja integrates with third-party email providers (Gmail, Outlook, Yahoo, etc.). Your use of those services is governed by their respective terms and privacy policies. We are not responsible for third-party services, and their availability may change without our control.

8. Disclaimers

The Service is provided "as is" and "as available." We do our best to make UnsubNinja reliable and useful, but we make no warranties, express or implied, including:

• That the Service will be uninterrupted, error-free, or secure
• That unsubscribe actions will always be successful (some senders don't honor unsubscribe requests)
• That all emails will be correctly categorized or identified
• That the Service will be compatible with all email providers or devices

We disclaim all warranties of merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by law.

9. Limitation of Liability

To the maximum extent permitted by law, DATECH CONSULTING, LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data, emails, or account access
• Lost profits or revenue
• Business interruption
• Any damages arising from your use of or inability to use the Service

Our total aggregate liability for all claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim — or $100, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless DATECH CONSULTING, LLC from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service or violation of these Terms.

11. Termination

• By you: You can stop using UnsubNinja and delete your account at any time. No questions asked.
• By us: We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. We'll try to give you notice when possible.

Upon termination, your right to use the Service stops immediately. Sections that by their nature should survive termination (disclaimers, limitation of liability, indemnification, governing law) will survive.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we'll notify you through the app or by email at least 30 days before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the new Terms. If you disagree with the changes, stop using the Service and delete your account.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in California. You consent to the personal jurisdiction of those courts.

14. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.
• Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
• Waiver: Our failure to enforce any right or provision doesn't constitute a waiver of that right.
• Assignment: You may not assign your rights under these Terms. We may assign ours in connection with a merger, acquisition, or sale of assets.
